Commercial plans "when required by the Ohio Building Code, plans shall be prepared in conformity with the Ohio Administrative Code". (Chapter 1303 of the Canton Codified Ordinances). Three complete sets of sealed (Seal Law) plans (building, plumbing, electric, heating ventilating, and air conditioning, and fire sprinklers or fire alarm) must be submitted with a completed City of Canton plan review form with signatures of authors of the drawings and the required fees. Plan review fees do not include the permit fees.

Complete plans for new homes must be submitted with a completed City of Canton plan review form. A $75.00 plan review fee is due upon submittal of plans. A zoning permit is also required.

Plans for garages, additions, storage buildings and sheds must be submitted and approved by the Building Inspector before a permit may be issued. The plans should include footing depth, type of foundation wall construction, roof construction to include size, spacing, and spans of lumber. A zoning permit is also required. The Building Inspector is in the office from 8:00 a.m. to 9:00 p.m. and 3:30 to 4:15 p.m. for the approval of these plans.

Decks must have a plan/sketch of the construction showing footing depth, floor construction, and size, spacing and span of lumber used. Specifications on railing and stairs if applicable. A zoning permit is also required. The Building Inspector is in the office from 8:00 a.m. to 9:00 p.m. and 3:30 to 4:15 p.m. for the approval of these plans.

Plans/sketch is required if changing a residential flat roof to a truss roof. Again, this plan must be approved by the Building Inspector.

Every commercial project is assigned a plans examination number for tracking purposes. Only the owner or his agent who originally submitted plans may request status or resubmit plans. The owner/agent and contractor must know this number and use it throughout the term of the project.

PLANS REQUIRED (4101:2-1-19) Before a building or addition to a building is constructed or erected, and before a building is altered or relocated, or building equipment is installed therein, or there is a change of occupancy, plans relating to the work and equipment under consideration shall be prepared in conformity with rule 4101:2-1-20 of the Administrative code and be submitted to the Building Official for inspection.

PLANS TO BE ADEQUATE (4101:2-1-19) Plans required under Rule 4101:2-1-18 of the Administrative Code shall be drawn to scale and shall be sufficiently clear, comprehensive, detailed, and legible when submitted to the Building Official. Plans shall designate the occupancy, type of construction, and the Fire Resistance Rating of all structural elements.

PLANS SHALL INCLUDE:

  1. Index of drawings
  2. Plot plan
  3. Floor plans
  4. Elevations
  5. Cross sections
  6. Complete structural data
  7. Mechanical/electrical systems

RESPONSIBILITY FOR PLANS (4101:2-1-20) Required plans, when submitted for inspection as required under Rule 4101:2-1-17 of the Administrative Code, shall bear the identification of the person primarily responsible for their preparation and for the provisions for safety and sanitation. Effective November 25, 1995 all plans shall bear the stamp of a professional architect or engineer (Seal Law).

CERTIFICATE OF OCCUPANCY (4101:2-1-27) A building or structure erected, enlarged, or altered shall not be used or occupied in whole or in part until the Certificate of Occupancy has been issued by the Building Official.

Plans are processed as a weekly batch, with the weekly deadline for submittal being Thursdays at 11:00 a.m. for the current week's processing. The OBC states that plans are to be reviewed in the order of receipt and allows 30 days for plan review. Our turn around time has been approximately 7 to 10 days (varies with demand).

PLANS EXAMINATION SUBMITTAL CHECKLIST

Please read and complete the Plans Exam Application carefully to prevent any delay in the processing and review of your Plans Exam and any resubmittals.

INITIAL SUBMITTAL

1) Completed plans exam application form with full and correct address.

2) Author of drawing certification signatures form.

3) 3 sets of complete drawings, assembled in sets with index of drawings on cover sheet.

MAIL-IN SUBMITTALS

If submittals are received via mail without the above information included, the application forms will be returned to applicant with appropriate boxes checked for information needed before a review will be conducted.

Plans submittals must list the full and correct address of the project on the Application Form. Also, the cover sheets of the drawings sets should list the full and correct address of the project.

If your project is a new structure, or other, that will have a new address, you must call Civil Engineering at 330-489-3381 to have an address assigned to the space before submitting plans. If your plans include an existing address as in a mall or strip mall, call the mall office/owner to get the correct address of the premises. DO NOT use the general/office address of the mall.

If your project is a new structure or is an addition to an existing structure, you must contact the Zoning Department at 330-430-7817 for information on obtaining a zoning permit.

THE SEAL LAW The Seal Law (House Bill 231)/ May 9, 1996

Since November 24, 1995, (effective date of House Bill 231, "Seal Law") there has been much controversy over "when a seal is required" and "consistency of enforcement" between various Building Departments throughout the State of Ohio.

The following is intended to state the position that the City of Canton Building Department will take with regard to Plan Submissions and enforcement of the administrative chapter of the Ohio Building Code under my direction as Chief Building Official.

Construction documents will be processed in a manner as described in the Ohio Building Code as indicated below.

WHEN TO SUBMIT PLANS?

(O.B.C. Reference 4101:2-1-17)

Before a building or addition to a building is constructed or erected, and before a building is altered or relocated, or building equipment is installed there, or there is a change of occupancy, plans relating to the work and equipment under consideration shall be prepared in conformity with Rule 4101:2-1-20 of the Administrative Code and be submitted to the building official for inspection.

Exceptions:

A. No plans need be filed for minor repairs; and

B. No site preparation or plot plans need be filed with the Division of Workshops and Factories for industrialized unit used exclusively for one, two, or three family dwellings. Effective July 1, 1995

No construction defined above is to commence without an approved set of plans stamped by the Chief Building Official.

WHEN & WHERE TO FILE PLANS?

(O.B.C. Reference 4101:2-1-18)

A. Pursuant to Section 3791.04 of the Revised Code, before entering into a contract for, or beginning the construction, erection or manufacture of any building for which plans are required under Rule 4101:2-1-17 of the Administrative Code, including all industrialized units, the owner thereof shall submit plans which shall indicate thereon the portions that have been approved pursuant to Section 3781.12 of the Revised Code, for which no further approval shall be required, to the building official for approval.

B. Plans shall be submitted in triplicate. Effective July 1, 1982

Three (3) sets of bound construction documents shall be submitted to the City of Canton Building Department at 424 Market Avenue North, Third Floor, Canton, Ohio 44702-1544 between the hours of 8:00 A.M. and 4:15 P.M., Monday through Friday, along with a copy of attached "Plans Examination" form. The examination form must be completed in its entirety as indicated on the form.

WHAT IS AN ADEQUATE PLANS SUBMITTAL?

(O.B.C. Reference 4101:2-1-19)

A. Plans required under Rule 4101:2-1-18 of the Administrative Code shall be drawn to scale and shall be sufficiently clear, comprehensive, detailed, and legible when submitted to the building office so that, together with any accompanying specifications and data, a person who is competent in such matters can determine whether or not the proposed building, addition, or alteration, and all proposed building equipment will conform in safety and sanitation to all applicable provisions of O.B.C.

B. If substantial changes to the building are contemplated after first plan submission, or during construction, those changes must be submitted to the building official for review and approval prior to those changes being executed. The building official may waive this requirement in the instance of an emergency repair, or similar instance.

C. Plans for all buildings shall designate the occupancy, type of construction, and the fire resistance rating of all structure elements as required by this code. The plans specifications shall include all documentation or supporting data substantiating all required fire resistance ratings.

D. Plans shall indicate how penetrations will be made for electrical, mechanical, plumbing, and communication conduits, pipes, and systems, and shall also indicate the materials and methods for maintaining the required structural integrity, fire resistance rating, and fire stopping.

E. Plans, when submitted to the building official for review, shall be in standard multiples of eight and one-half inches by eleven inches or nine inches by twelve inches in size, and shall include:

1. An index of drawings located on the first sheet;

2. A plot plan showing street location; the location of the proposed building and all existing buildings on the site; including setback and sideyard dimensions; distances between all buildings; and location and sizes of all utility lines;

3. Floor plans, including plans of full or partial basements or cellars and full or partial attics or penthouses. Floor plans must show all relevant information such as door swings, stairs and ramps, windows, shafts, etc.; and must be sufficiently dimensioned to describe all relevant space sizes. Wall materials must be described by crosshatching (with explanatory key), by notation, or by other clearly understandable method. Spaces must be identified by code appellation, i.e., an "auditorium" may not be identified as "meeting room" if its size and function dictates that it is an auditorium;

4. All elevations necessary to completely describe the exterior of the building including floor to floor dimensions;

5. Cross sections, wall sections and detail sections, to scale, as may be required to describe the general building construction including wall, ceiling, floor and roof materials and construction; and details which may be necessary to describe typical connections, etc;

6. Complete structural description of the building on the above drawings or on separate drawings include size and location of all principal structural elements and a table of live loads used in the design of the building and computations, stress diagrams and other data sufficient to show correctness of plans;

7. Complete description of the mechanical and electrical systems of the building on the above drawings or on separate drawings, including plumbing schematics and principal plumbing, heating, ventilation and air conditioning duct and piping layouts and lighting and power equipment layouts; and

8. Additional graphic or text information as may be reasonably required by the building official to allow him to review special or extraordinary construction methods or equipment.

As identified above, all construction documents must be clear, comprehensive, detailed, dimensioned, legible and drawn to scale to permit the plans examiner a thorough review to confirm compliance with the current Ohio Building Code. The "Plans Examination" form becomes part of the submission; therefore, it is important that the author of drawings complete application section #3 in its entirety identifying pertinent information to the design such as type of work, proposed use group, construction classification, building heights/areas, etc., all of the above are important for a formal plans examination.

To assist the applicant in processing plans, a "Plans to be Adequate" check list has been included on the "Plans Examination" form (section #5) for your use.

Also, a "Submittal Check List" has been provided (above) to assist you with the required information in making a complete plans submission.

WHO IS RESPONSIBLE FOR PLANS SUBMITTAL?

(O.B.C. Reference 4101:2-1-20) (House Bill 231)

A. Required construction documents, when submitted for inspection as required under rule 4101:2-1-17 of the Administrative Code, shall bear the identification of the person primarily responsible for their preparation and for the provisions for safety and sanitation show therein.

B. Construction documents, when submitted for inspection as required under rule 4101:2-1-17 of the Administrative Code, shall bear the seal of a registered design professional pursuant to sections 3791.04, 4703.12 and 4733.14 of the Revised Code.

Exception: the seal of a registered design professional is not required on construction documents for:

1. Buildings or structures classified in use group R-4.

2. Energy conservation design for buildings or structures classified as one-, two-, or three-family dwellings; and

3. Automatic sprinkler or fire alarm system designs submitted under the signature of an individual certified in accordance with paragraph (d) of rule 4101:2-1-22 of the Administrative Code.

4. Installation of replacement devices, equipment or systems that are equivalent in type and design to the replaced devices, equipment or systems.

5. Alterations or repairs to any buildings or structures subject to sections 3781.06 to 3781.18 and 3791.04 of the revised code where the building official determines that the proposed work does not involve the analysis or design or work affecting public health or general safety in the following areas: means of egress, structural, mechanical, electrical, plumbing, or fire protection.

It is the intent of the City of Canton Building Department to provide the applicants with a thorough plans review to assure they are in compliance with O.B.C. This can only be performed with a proper submission of documents.

The Building Department has a Building Technician, Mr. John Elavsky, assigned to assist you in "Plans Submission". The City has provided a designated "plans examination" phone line (330) 430-7805 to assist you with any questions you may have in preparing a submittal or you may come to the Plans Examination counter in the Building Department.

Although every effort will be made to assist the applicant in submitting documents, where work involves "the analysis of design" the City of Canton staff are not authorized to design or assist you in the design of your facility. The design can only be by a professional architect or engineer who accepts responsibility for safety and sanitation. I encourage preliminary review meetings with owners and professionals to discuss schematic designs to avoid any misinterpretations of the O.B.C. on final submittals.

All construction documents, when submitted for review, shall bear the seal of a registered design professional unless the documents meet one of the five (5) exceptions listed above.

Every plans submission brought to the Building Department for review will be processed at the applicant's request. However, if the Building Technician's preliminary evaluation of the submission at the counter finds that insufficient information has been included, he may suggest the applicant provide additional information prior to submission to avoid possible delays with receiving a "rejection of plans" or "revise/resubmit" directive. No applicant will be denied the right to make a submittal, even if informed of insufficient construction documents.

In addition, the Building Department has no authority to enforce the laws of the State of Ohio Board of Examiners of Architects with regard to sealing of drawings which are stated below.

A. All documents submitted to a building department by an architect must have the title sheet or first sheet of a bound set of documents embossed over an ink signature. All loose sheets of documents must also be embossed and signed with an ink signature. It is recommended for your protection, that the signature be dated.

B. The rubber stamp version of the seal of the architect must also be placed on all tracings to provide a legible reproduction. Remember, proper sealing is for your protection from others who may alter or otherwise use your documents without your permission.

We would, however, recommend that all applicants follow these laws when submitting drawings because our files are public records and the Board of Examiners of Architects check our files and enforce their regulations.

In addition, all building departments have been informed that the Board will also be enforcing "Plan Stamping". (Stamping of drawings which architects have not prepared under their direct supervision.)

HOW ARE DRAWINGS PROCESSED?

(O.B.C. Reference 4101:2-1-22)

A. A certified plans examiner shall review plan and specifications to determine compliance with O.B.C.

B. Plans submitted for approval shall be examined for compliance with O.B.C. in the order received, unless otherwise consented to by the building owners affected by deferred examination.

When documents are submitted, the applicant is assigned an examination number (ex: 2000-000) which remains with the project during construction and is also identified on the Certificate of Occupancy for future work as well. This number is found on the receipt given to the submitter. Make sure everyone involved with the project knows that plans examination number. You must use that number when you call in to inquire about the plans or project, when you pick up drawings, when the contractors pull their permits, call for inspections, etc.

If you need to resubmit drawings or submit additional drawings or other information about a project, make sure to include a copy of the latest Plans Examination Application Form with any submittal or correspondence.

Drawings are logged into the file and reviewed in the consecutive order in which they are processed. No exceptions taken, unless by written deferred consent by owners affected.

The City of Canton makes every effort to review plans as promptly as possible because we know how important the construction period is to everyone involved. Our normal turn-around time for document review is 7-10 working days. However, during periods throughout the year, depending upon construction activities, this sometimes can take longer but not to exceed 30 days. If resubmittals are not timely on the part of the applicant and exceed 30 days a rejection of plans may occur.

HOW TO ACHIEVE A PLANS APPROVAL?

(O.B.C. Reference 4101:2-1-23)

A. When the building official finds that plans submitted for approval conform to the applicable provisions of O.B.C., he shall endorse or stamp such plans as approved.

B. When plans are submitted which do not conform with the requirements of O.B.C., such plans may be approved by the building official provided such nonconformance does not consist of a condition considered to be a "serious hazard" and the owner or his representative subsequently submits revised plans, addenda, or other data to show evidence of compliance with the applicable provisions of O.B.C. In the event such data is not received within a reasonable length of time, not to exceed 30 days, the building official shall revoke the plan approval.

The plans examiner, after reviewing the documents, will complete a "Correction Letter" listing a description of deficiencies along with the O.B.C. code section where reference is cited.

It is the "Author of Drawings" responsibility to respond to each of the items listed in writing and/or in drawing form to bring the documents into compliance with the O.B.C. in a timely manner, not to exceed 30 days. The "review status" will be appropriately marked.

This correction letter also may serve as an adjudication order and lists a "statement of right to appeal" the plans examiners actions taken. You may request a hearing by making application to the Ohio Board of Building Appeals at the Ohio Department of Commerce, PO Box 4009,6606 Tussing Rd., Reynoldsburg, OH 43068, along with a $100.00 application fee. If you have any questions, please contact the Ohio Board of Building Appeals at 614-644-2616.

When plans are picked up after the review, the Building Department gives out three copies of the completed Plans Examination Application Form that has the assigned number on it at the top right corner. One copy is for the contractor to work from and is to be kept at the site at all times. A second copy is stamped for the owner. A third copy is stamped for the author of drawings of record. It is the responsibility of the person picking up the drawings after the review to make sure that the copies are distributed to the proper locations. DO NOT call the Building Department to look up the Plans Exam Number. It will already have been distributed to many principals involved with your project and you should be able to easily obtain the number of your project from one of those sources. The Building Department processes hundreds of plans exams each year. It is your responsibility to keep track of your individual project by the Plans Exam tracking number.

If you are a General contractor that has not previously obtained permits in the City, and you are coming in to pick up approved drawings and the associated Building permit, the Building Department will need to know your company name, address, phone number, and the name of the company owner or president. Also, if the person coming in to pick up the plans is not the company owner or president, then the Building Department will need a letter, signed by the company owner or president that gives authorization to the specific person coming in to pick up the plans and permit for the company.

WHAT TO DO WITH APPROVED PLANS?

(O.B.C. Reference 4101:2-1-24)

A. One set of plans which have been approved under Rule 4101:2-1-23 of the Administrative Code shall be returned to the owner. One identical set of such plans shall be kept at the site of the work and shall be available for reference by the building official at all times during working hours while such work is in progress.

B. The building official shall stamp or endorse additional sets of plans which have been approved by him, in addition to the sets required under Rule 4101:2-1-18 of the Administrative Code, when so requested by the owner or his agent.

City inspectors are confirming that work in place matches the "approved documents" on file. One set of approved plans stamped by the Building Official must be available at the job site at all times for this purpose. If plans are not at the site, they cannot effectively do their inspections, which may result in a re-inspection fee and a time delay on your part.

WHAT IF CHANGES ARE NEEDED TO THE PLANS?

(O.B.C. Reference 4101:2-1-25)

The construction, erection, and alteration of a building, and any addition thereto, and the equipment and maintenance thereof, shall conform to required plans which have been approved by the building official, except for minor deviations which do not involve a violation of O.B.C. In the absence of fraud or a serious safety or sanitation hazard, any structure built in accordance with approved plans shall be conclusively presumed to comply with Chapters 3781. and 3791. of the Revised Code and O.B.C.

The inspectors have no authority to approve contractors to make changes or authorize additional work at the job site except for minor deviations not affecting the design intent of the documents.

Any deviations to the plans or addition to the project scope must be made as an addendum to the plans by the "Author of Drawings" only and filed with the plans examiner for approval on the "plans examination" form.

WHERE TO RECEIVE A CERTIFICATE OF PLAN APPROVAL?

(O.B.C. Reference 4101:2-1-26)

A. After plans have been approved under Rule 4101:2-1-23 of the Administrative Code, the building official shall furnish the owner of the building or equipment to which the plans relate a certificate of approval of such plans.

B. The form of the certificate shall be as prescribed by the building official and shall show the serial number of the certificate, the address at which the building or equipment under consideration is or is to be located, the name and address of the owner, the name of the person who issued the certificate, and such other information as is necessary to facilitate and insure the proper enforcement of O.B.C.

C. The certificate of approval of plans shall be posted in a conspicuous location outside of the building and in the front part of the premises on which is, or will be, located the building or equipment to which the approved plans relate. The owner and the contractor shall, so far as possible, preserve and keep said certificate posted until the completion of the work to which the approved plans relate. Upon application by the owner, the building official shall issue a duplicate certificate of approval to replace one destroyed by vandals or one which is accidentally destroyed. Effective July 1, 1979

When plans are approved and received by the owner's agent or representative, he will be given a fluorescent green "Certificate of Plan Approval" to be posted at the project site. This certificate also serves as a permit for construction and record of inspections. The inspectors will place colored "stickers" of approval on the fluorescent green sheet for each phase and type of work being inspected along with the date the inspection was made.

IS A CERTIFICATE OF OCCUPANCY REQUIRED?

(O.B.C. Reference 4101:2-1-27)

A. New buildings: A building or structure hereafter erected shall not be used or occupied in whole or in part until the certificate of occupancy shall have been issued by the building official

.

B. Building hereafter altered: A building or structure hereafter enlarged, extended or altered, in whole or in part, shall not be occupied or used until the certificate of occupancy shall have been issued: except that any use or occupancy which was not discontinued during the work of alteration shall require the issuance of a certificate by the building official within 30 days after completion of the alteration.

C. Change of occupancy: A building or structure hereafter changed, in whole or in part, from one occupancy to another, shall not be occupied for the new occupancy until the building conforms to the applicable provisions of this code for the new use and the certificate of occupancy shall have been issued by the building official for such changed portions.

D. Existing buildings: Upon written request from the owner of an existing building or structure, the building official shall issue a certificate of occupancy, provided there are not violations of law or orders of the building official pending, and it is established after inspection and investigation that the alleged occupancy of the building or structure has heretofore existed. This code shall not require the removal, alteration or abandonment of, or prevent the continuance of, the occupancy of a lawfully existing building or structure, unless such use is deemed to endanger public safety and welfare.

E. Temporary occupancy: Upon the request of the holder of a permit, the building official may issue a temporary certificate of occupancy for a building or structure, or part thereof, before the entire work covered by the permit shall have been completed.

A certificate will be issued at the completion of each project after final inspection and at the request of the owner or agent/representative. No occupancy shall take place until issued. (see attachment E)

WHEN ARE SEALED DRAWINGS REQUIRED FOR SIGN CERTIFICATE OF PLAN APPROVAL/PERMITS? (O.B.C. Reference 4101:2-31-02)

O.B.C. 3107.0

Permits and Construction Documents: Permits and Construction Documents for signs shall be required as specified in O.B.C. Section 3107.1 and 3107.1.1 except as provided for in Section 3107.1.1 Exceptions.

New signs: A new sign shall not hereafter be erected, constructed, altered or maintained except as provided for herein, and until a permit has been issued by the code official.

Alterations: A sign shall not be enlarged or relocated unless such sign conforms to the provisions of this section for new signs, or until a proper permit has been secured. The changing of movable parts of an approved sign that is designed for such changes, or the repainting or reposting of display matter, shall not be deemed an alteration, provided that the conditions of the original approval and the requirements of this section are not violated.

Construction documents and owner's consent: Before any permit is issued for the erection of a sign, construction documents shall be filed with the code official showing the dimensions, materials and required details of construction, including loads, stresses and anchorage. The applications shall be accompanied by the written consent of the owner or lessee of the premises upon which the sign is to be erected.

Zoning law: When more restrictive in respect to location, purpose, size or height of signs, the limitations of zoning laws that affect required light and ventilation requirements and occupancy of land shall take precedence over the regulations of this code.

The City of Canton has established the following Zoning and Building regulations as a "general guideline" for establishing which applications for sign permits will require sealed plans be filed by a Ohio Professional per O.B.C. 4101:2-1-20.

1. All pole signs.

2. Ground signs more than 4' in height and 32 square feet in area; measurements including base dimensions.

3. Billboards and off premise signs.

4. Projecting wall signs exceeding 28 square feet in size or 18" in projection from wall.

5. Roof mounted signs.

All documents to include the general requirements as identified in O.B.C. Section 3102.6 and including but not limited to:

1. Wind load resistance.

2. Footing sizes and framing specifications, when applicable.

3. Structural framing sizes and method of installation to wall, when applicable.

4. Illuminated signs shall include wiring details in compliance with N.E.C.

The City of Canton Building Department has made every effort to assist owners, contractors and professional architects and engineers in completing a successful construction project from "Plans Submission", through issuance of a "Certificate of Occupancy".

I have attempted to state the appropriate chapters of the administrative section of the O.B.C. which I am certified and obligated to enforce for all construction projects within the City of Canton.

FEES: There is a fee for Plans Examination. The Building Department accepts cash, checks (made out to the City of Canton) at the time of submittal.

The fees are calculated at the top of page two of the Plans Exam Application. The fee is $100, PLUS $2.00 per 100 square feet of project square footage for each review of each trade that is submitted. TOTAL all of those fees and then ADD a straight 3% for the Ohio Board of Building Standards Fee.

Note: To obtain the square footage number, you total the square footage of the project area of work and then round it up to the next even hundred number (example: If the project area of work is 1,812 SF, you round it up to 1,900 SF.)

The fee is applied to each type of review. ( example: If the project involves building construction and electrical work, then there is a fee paid for Building review and Electrical review.)

Note: If there are FIRE SPRINKLER drawings in the set - Add another $100 application fee and another square footage fee for Fire sprinkler review. On Page three of the Plans Exam Application Form, there is a separate line to be filled in for "fire Sprinkler Designer Information".

If Fire Alarm drawings are submitted separately the fee will be the $100 application fee plus the square footage fee and the straight 3% fee.

If Fire Alarm drawings are submitted with a set of drawing that also include electrical drawing, or sprinkler drawings, the no additional fee will be charged for the fire alarm review.

Attention: Fire Alarm Drawings are NOT to be included in, or considered part of, the electrical drawings. They receive their own review and there may be a separate fee that must be paid for Fire Alarm review. Also, on page three of the Plans Exam Application Form there is a separate line to be filled out for Fire Alarm designer information.
